PARIS (Reuters) - Um projeto de lei da França que propõe desconectar internautas que fizerem downloads de música ou vídeo de forma ilegal disparou críticas de grupos de defesa dos consumidores e de parlamentares.
O governo quer reduzir o fluxo de músicas e filmes que circulam livremente pela Internet, privando artistas de receitas por seu trabalho e ameaçando a sobrevivência das empresas produtoras.
"Artistas precisam viver. Estamos acabando com eles. Precisamos reagir e ter coragem de assumir nossas responsabilidades", disse Jean-François Cope, presidente do partido UMP, da situao.
As gravadoras t磪m sido atingidas pela pirataria na Internet. Cerca de 95 por cento das músicas baixadas da Web no mundo em 2008, ou mais de 40 bilhões de arquivos, era ilegal.
A proposta francesa afirma que os usuários que baixarem arquivos ilegalmente precisam receber um alerta por email. Se eles voltarem a repetir a prática receberão um segundo aviso por carta registrada. Caso sejam pegos por uma terceira vez, serão desconectados da Internet por dois meses a um ano.
Críticos afirmam que a proposta é muito difícil de ser aplicada. Eles sustentam ainda que o projeto colocará os artistas contra seu próprio público e poderia representar um risco para usuários honestos da Internet que podem ser penalizados indevidamente.
"O texto é ruim e apresenta uma série de problemas. Além disso ele se opõe a artistas e internautas. Provavelmente nunca será implementado", afirmou Patrick Bloche do partido Socialistas, de oposio.
Grupos de defesa dos consumidores afirmam que ser磡 muito fácil para crackers usarem endereços IP de outros computadores para baixarem arquivos.
"A proposta viola o princípio da presuno de inoc磪ncia porque o ônus da prova ficará sobre os usuários de Internet", disse o grupo UFC-Que Choisir.
O projeto passou pelo Senado em outubro passado, mas pode enfrentar um caminho mais difícil na Câmara esta semana. O Socialistas informou que votará contra o texto, enquanto o grupo de centro normalmente aliado ao UMP está se mostrando hesitante. Mesmo um pequeno número de parlamentares do UMP criticam a proposta.
A indústria de mídia e governos têm lutado para encontrar respostas ao fenômeno da troca de arquivos pela Internet desde que serviços populares como o Napster surgiram no final dos anos de 1990.
Em janeiro, o provedor de Internet irlandês Eircom concordou em desconectar usuários pegos fazendo download ilegal de música. O provedor fechou acordo com quatro grandes gravadoras de música e a mídia irlandesa informou que o acerto foi o primeiro do tipo no mundo.
Na Inglaterra, o governo anunciou em janeiro planos para fornecer acesso rápido à Web em todo o país até 2012 enquanto ao mesmo tempo introduziu nova legislao que for磧a provedores de Internet a tomarem medidas contra usuários que violarem leis de direitos autorais.
